‍Content and Files: In using our Services, you may input or upload various content – for example, text prompts, documents, design files, code, images, or other data (“Your Content”). QTex AI’s systems process this content to provide you with the AI-driven results or other functionality of the platform. Except for limited circumstances described in this Privacy Statement (such as to ensure our systems work properly, or if you choose to share your content), QTex AI does not proactively access or use the specific content of your files or communications for any purpose other than to deliver the service to you. In particular, we do not use the content of your private documents or conversations to train our public machine learning models, nor do we sell or disclose that content to third parties. (See “How We Use Information” below for more detail on content use.)

‍Usage Data: QTex AI automatically collects certain information about how you access and use our Services. This includes technical information like your IP address, browser type, device type, operating system, and timestamps of your interactions. We also record usage metrics such as the number of messages or requests you send to our AI, the features or tools you use, pages or screens you visit on our app or website, and other activity logs. For example, our system might log that a particular account made 40 queries in a month, or that you used a specific design feature at a certain time. This usage data does not include the content of your messages or files, but it may include metadata (e.g., file sizes or the duration of a session). If the Services encounter an error or crash, we might collect a crash report or error log to diagnose the issue. We may use cookies or similar tracking technologies (like web beacons and local storage) to collect some of this usage information on our websites (see “Cookies and Tracking” below).

‍Third-Party Sources: Generally, QTex AI does not collect personal data about you from third-party sources, except in two scenarios: (a) if you sign in or authenticate via a third-party platform (for instance, if we enable “Sign in with Google” or similar, we would receive basic profile info from that service with your consent); or (b) if a business or enterprise partner provides us your information for account provisioning (for example, your employer may give us your email to set up a team account). In such cases, we treat that information in accordance with this Privacy Statement and any additional terms in place with the partner. We do not purchase marketing lists or personal data from data brokers.

‍Children’s Data: QTex AI’s Services are intended for users who are at least 16 years old (or the age of majority in your jurisdiction, if higher). We do not knowingly collect personal data from children under 16. If we become aware that a child under 16 has provided us personal information, we will take steps to delete it. If you are a parent or guardian and believe we have information regarding a minor, please contact us. (Note: A separate Children’s Privacy Statement may apply for any educational versions or child-directed features of QTex AI, in which case we will obtain verifiable parental consent as required by law.)

QTex AI uses the collected information for the following purposes:
·       To Provide and Maintain the Services: We use your personal data to create and manage your account, authenticate you when you log in, and operate the core functionalities of our platform. For example, we use the content you input to generate AI outputs or to store documents on your behalf. If you are a Pro team admin, we use your information to facilitate team management and billing.
·       To Process Transactions: We use billing information (like your name and payment details) to process subscription payments, renewals, or other transactions you have requested. We also send purchase confirmations, invoices, and renewal notices as needed.
·       To Improve and Develop Our Services: QTex AI is committed to continually improving its AI models and user experience. We use usage metrics and aggregated data to understand how the Services are performing and how users interact with the platform. For instance, knowing which features are most popular or where users encounter errors helps us prioritize updates and enhancements. We may analyze usage trends or perform statistical analyses on aggregated data (which does not identify individuals) to improve functionality, reliability, and user interface. We do not use the specific content of your private interactions (e.g. the text of your conversations or documents) to improve our public models or features unless you give us permission. However, we may use information about errors or failures that occur while processing your content to fix bugs (for example, if a particular file consistently fails to upload, we might examine the error logs, which could include limited data about the file structure). All such internal uses are aimed at improving the service’s quality and are handled with respect for your privacy.·
      To Communicate with You: We use contact information (email address, phone number if provided) to send you service-related communications. These include confirmations of sign-up or cancellation, billing receipts, customer service responses, and important announcements about security or major changes to the Services. We may also send you optional communications about product updates, new features, newsletters, or events, but you will have the ability to opt out of marketing emails if you prefer. We will not spam you or contact you for marketing unless you have given consent or it is otherwise allowed by law.
·       To Provide Customer Support: If you reach out for support, we will use your information to assist you, such as troubleshooting issues, answering questions about your account or billing, or addressing any problems you’re experiencing. Support interactions may involve accessing certain account information or, with your permission, limited portions of Your Content if needed to resolve the issue. Our support team is bound to confidentiality and will only use such data to help you.
·       To Enforce Terms, Prevent Abuse, and Ensure Safety: We may process personal data to enforce our Terms of Use and other policies, to prevent fraudulent, harmful, or illegal activities, and to protect the rights, property, and safety of QTex AI, our users, or the public. For example, we might use automated tools to detect accounts engaging in spam or other prohibited behavior. If necessary, we may also use information to investigate or take action regarding potential violations of law or security incidents (such as analyzing logs following a breach attempt).
·       Legal Compliance: Finally, we will use or disclose personal information as we believe necessary or appropriate to comply with applicable laws and lawful requests, such as to respond to subpoenas or court orders, or to cooperate with law enforcement or regulatory authorities. We also may use your information to exercise or defend legal claims.

We do not use your personal information for purposes incompatible with those listed above without asking for your consent. In particular, we do not sell your personal data to data brokers or advertisers, and we do not share your information with third parties for them to market their own products to you. Our use of data is limited to providing and improving the QTex AI platform and communicating with you as described.

QTex AI understands that you trust us with your information, and we do not share personal data with third parties except in the limited scenarios described here:
·       Service Providers (Processors): We employ third-party companies and individuals to facilitate our Services and to perform certain functions on our behalf – for example, cloud infrastructure providers (to host our servers and data storage), payment processors (to handle secure credit card transactions), email delivery services (to send out verification or notification emails), and customer support software providers. These providers will have access to personal information only to the extent necessary to perform their tasks for us and are contractually obligated to protect it and not use it for any other purpose. For instance, our payment processor will receive your billing information to process payments, but they are not permitted to use your details for their own marketing.

Any such affiliate will be required to honor the same commitments to your privacy.

For example, if you participate in an QTex AI joint marketing program or a referral partnership that involves sharing data with a partner company, we will do so only with your knowledge and consent.

‍Public Sharing: Some areas of our Services might allow you to post content that can be visible to others (e.g., public forums, galleries, or community support boards). If you choose to contribute content or personal information in these public areas, be aware that this information can be read, collected, and used by anyone who accesses them. We strongly encourage you not to post personal data (like your contact info or sensitive details) in public forums. QTex AI is not responsible for the personal information you choose to make public in these interactive features.

Importantly, QTex AI does not share your personal data with third-party advertisers or ad networks. We do not engage in selling user information for profit. Any sharing that does occur is strictly for the purposes of delivering our service or as required by law, as outlined above.

Cookies: QTex AI uses cookies and similar tracking technologies on our website to provide and optimize the Services. Cookies are small text files placed on your device to store data that can be recalled by a web server in the domain that placed the cookie. We use cookies for several reasons:
·       Essential Cookies: These are necessary for the website to function. For example, when you sign in to your account, we use authentication cookies to maintain your session. Without these, you wouldn’t be able to stay logged in as you navigate through our site.

However, please note that if you choose to block essential cookies, some features of the Services (like maintaining a logged-in session) may not work properly. ‍Do Not Track: Some browsers offer a “Do Not Track” (DNT) signal. Because there is not yet a common understanding of how to interpret the DNT signal, our systems currently do not respond to browser DNT signals. We will update our practices if an industry standard for DNT is established in the future.

Account Data: We retain your personal information for as long as your account is active or as needed to provide you with Services. This means, for example, that we will keep your profile information, account credentials, and content stored in your account until you delete that data or close your account. If you choose to delete certain content, we will remove it from active systems, but note that some residual copies may remain in our backup systems for a limited period (we regularly purge backups on a rolling schedule) or as otherwise required by law.

‍Subscription and Transaction Data: We retain records of your subscriptions, payments, and transactions as long as necessary for financial reporting and compliance (typically at least seven years, depending on jurisdiction, for accounting and tax regulations). If you cancel a paid subscription, we will keep a record of your account and transactions for our records and to respect any opt-out or legal hold obligations, but we will no longer actively use your payment information except as needed for lawful accounting.

‍Usage Data: We generally aggregate or anonymize usage data (so it can no longer be linked to any individual user) and may retain this aggregated data indefinitely for analytics and service improvement purposes. If usage logs are tied to personal data or account identifiers, we treat them as personal data and typically retain them for a shorter period, unless needed for security analysis or legal obligations. For example, server logs containing IP addresses may be kept for a few months for debugging and security monitoring, then either deleted or anonymized.

‍Account Deletion: If you choose to delete your entire QTex AI account, we will initiate the process to remove personal data associated with your account from our systems (except data we are permitted or required to retain as noted below). Account deletion typically results in removal of login credentials, profile information, and stored content from active databases. Please note it may take a short period to complete the deletion process, and we may retain certain information after deletion:
- Legal Obligations: We might retain information if needed for legal compliance or legitimate business interests. For instance, we may keep transaction records to comply with financial laws, or certain communications to establish, exercise, or defend legal claims.
- Security and Abuse Prevention: We may retain information necessary to investigate or prevent abuse and fraud. For example, if an account was terminated for violating our Terms, we might keep a record of that to prevent the user from re-registering in violation of our rules.
- Backup Archives: As mentioned, data may persist for a time in backups. If we restore a backup after you’ve deleted data, we will make efforts to honor the deletion (for instance, the data may be deleted again or anonymized in the restored backup set).In summary, we strive not to keep personal data in identifiable form longer than necessary to fulfill the purposes for which it was collected, and as required or permitted by law. When personal data is no longer needed, we will securely destroy or irreversibly anonymize it.

Depending on your jurisdiction and applicable data protection laws, you may have certain rights regarding your personal data. QTex AI is committed to honoring rights that apply to our users. These may include:
·       Access and Portability: You have the right to request a copy of the personal data we hold about you and to obtain it in a commonly used electronic format. For example, you can request a copy of your account information or content that you have provided to us. (Most of Your Content can be downloaded directly by you through our Services interface.)
·       Rectification (Correction): If any of your personal information is inaccurate or incomplete, you have the right to ask us to correct it. You can also update some of your account information directly by logging into your account settings.
·       Deletion: You have the right to request deletion of your personal data. As described in the Data Retention section, you may delete specific pieces of content or your entire account. You may also contact us to request deletion of certain data we hold that might not be accessible to you online. We will honor deletion requests to the extent required by applicable law, and will inform you of the outcome. Some information cannot be deleted if we have a continuing legal obligation to retain it (for example, records of a purchase transaction for accounting).
·       Objection and Restriction: You have the right to object to or ask us to restrict processing of your data in certain circumstances. For instance, you can object to processing of your data for direct marketing (and in fact, QTex AI does not do direct marketing without your consent). If you believe we have no lawful basis for a particular processing activity, you can object or request restriction; we will review such requests and respond as required by law.
·       Consent Withdrawal: If we rely on your consent to process your personal data, you have the right to withdraw that consent at any time. For example, if you consented to receive promotional emails, you can opt out via the unsubscribe link in those emails or by adjusting your account preferences. Withdrawing consent will not affect the legality of processing based on consent before its withdrawal.
·       Non-Discrimination: QTex AI will not discriminate against users for exercising their privacy rights. For example, if you choose to opt out of marketing communications or request deletion of your data, we will not deny you services or provide a lower quality of service, except as allowed by law (recognizing that deleting essential data might affect our ability to provide service).

Payments are processed automatically on a [monthly/annual] basis according to your selected plan. You are responsible for keeping your payment details current and ensuring that sufficient funds are available to cover your subscription fees.

QTex AI is headquartered in the United States, and our primary data systems are currently located in the U.S. Depending on where you are located, using our Services may result in the transfer of your personal data across international borders. For example, if you are in the European Economic Area (EEA) or United Kingdom, your personal data may be transferred to and processed on servers in the United States. We are committed to ensuring that such transfers comply with applicable data protection laws. We utilize appropriate safeguards for cross-border data transfers as required by relevant regulations. This may include relying on standard contractual clauses approved by the European Commission for data transfers, or verifying that our service providers are certified under frameworks like the EU-U.S. Data Privacy Framework or similar.
