1. Ownership of User-Created Content
Your Content, Your Ownership: Content that you create, upload, or otherwise bring into existence by using QTex AI remains your property. This includes, for example, the text prompts you write, the designs or models you develop, the documents or code you generate, and any other output that is the result of your use of our Services (collectively, “Your Content” or “User Content”). QTex AI does not claim any ownership rights in Your Content. As between you and QTex AI, you retain all intellectual property and proprietary rights that you have in the content you create. If something you create is legally capable of being protected by copyright, and you would be the author or owner under the law, then you remain the copyright owner of that work. If Your Content includes any of your trademarks, you likewise retain those rights. QTex AI’s Terms of Use require that you only upload or create content that you have the rights to use; accordingly, if you incorporate someone else’s copyrighted material into Your Content (for instance, you upload a third-party image or text), you must have the legal right to do so, and the resulting ownership of that compilation or derivative work will depend on arrangements outside of QTex AI’s control (we make no claim to the parts that are not originally yours).
License to QTex AI: While we do not own Your Content, by using our platform you grant QTex AI a limited license to use Your Content solely for the purposes of operating and improving the service, as explained in our Terms of Use and Privacy Statement. This allows us to process your data (for example, to feed a prompt into our AI model and return results to you, or to save your work to your account so you can access it later). We do not use Your Content for unrelated purposes, and we do not transfer your content to third parties except as permitted (e.g., to our cloud service provider for storage, under strict protections). QTex AI will never sell Your Content. Also, if you delete Your Content or terminate your account, we will cease any use of that content (aside from transient backup copies as noted in our policies). The license you give us to handle your content is described in the Terms of Use (Section 7, “User Content and Output” and Section 8.5 “Use of Your Content”) – it is necessary for technical operation, but it does not diminish your ownership.
AI-Generated Output: As noted, QTex AI’s platform may produce AI-generated content (“Output”) in response to your inputs. To the extent permitted by law, QTex AI disclaims any ownership of such Output – we consider it your Content, as it was generated for you. However, because of the nature of AI, the Output could be similar to material seen elsewhere or produced for others, and may not be eligible for copyright protection (for example, purely machine-generated text might not meet the legal criteria for copyright in some jurisdictions). QTex AI makes no warranty that Output will be unique or original. If originality or exclusivity of content is important for your use case, you should carefully vet the Output and possibly consult legal counsel regarding its status. That said, QTex AI does not assert ownership over the ideas or expressions in the Output beyond the underlying AI model’s rights (which we own – see below). Put simply: if you prompt our AI to write you an article or generate a design, we won’t later claim that article or design belongs to QTex AI. It’s yours to use, share, modify, or even commercialize as you see fit, subject to any third-party rights that might be inadvertently implicated (e.g., if the AI output includes a famous quote or a brand name, your use of that output could still need clearance from the third-party rights holder). Always ensure your use of AI Output doesn’t violate someone else’s rights.
User Responsibility: You are responsible for the content you create and share on QTex AI. This means you should not incorporate materials into Your Content unless you have the right to use them. For example, uploading someone else’s copyrighted photo without permission, or copying large text from a book you didn’t write, can infringe copyright. You also should not use QTex AI to generate content that infringes someone’s copyrights (e.g., asking the AI to reproduce a copyrighted song or article verbatim is not allowed). If you do these things, you could be liable for infringement, and QTex AI’s policies (Terms of Use and Acceptable Use Policy) allow us to remove infringing content and suspend or terminate accounts of repeat infringers. We may not proactively monitor everything, but we take IP rights seriously and will act if we’re made aware of violations. By retaining ownership of Your Content, you also assume responsibility: if you share Your Content publicly (for instance, in a community forum or by publishing a project), others might view or use it, and QTex AI isn’t responsible for what third parties do with content you’ve made public. If you want to keep something proprietary, do not share it in public areas of our site. Use the appropriate privacy settings and team sharing controls.
2. QTex AI’s Intellectual Property Rights
QTex AI Content: Except for Your Content, all content and materials available through our Services are owned by or licensed to QTex AI, and are protected by intellectual property laws. “QTex AI Content” includes, but is not limited to: the software and source code that operates the platform; the algorithms and AI models; the design elements and user interface of our website and apps; the text, images, logos, graphics, and other materials provided by QTex AI on our website (such as documentation, tutorials, blog posts, and marketing materials); and the compilations and arrangements of content (even if individual pieces of content are user-provided). QTex AI and its licensors (such as any partners who provided licensed data or software) retain all proprietary rights in these materials.
When you subscribe to or use QTex AI, you are granted a limited license to use QTex AI’s software and content for its intended purpose – namely, for you to interact with our AI and get results for your personal or internal business use. This license is subject to the conditions in our Terms of Use (see especially Section 8.1 and Section 13 of the Terms). It is not a transfer of ownership. For example, just because you have access to our AI model via the service doesn’t mean you own the model or have the right to extract it or use it outside the service. You may not copy or distribute QTex AI’s software or content without permission, except as allowed by law or expressly permitted here. We want you to benefit from using the platform, but we also must protect our investment and rights in the technology and content we’ve created or licensed.
Permissible Use of QTex AI Content: We understand that users or third parties may sometimes want to reference or use QTex AI’s own content (like screenshots of the software, excerpts from documentation, or QTex AI-provided templates/models) in various contexts (education, reviews, integration with other systems, etc.). Here are guidelines for common scenarios:
· Screenshots & Videos: You may include screenshots or recordings of QTex AI’s interface in instructional materials, reviews, or presentations for non-commercial, informational purposes (such as a tutorial or a critique), provided that you do not modify the QTex AI logos or interface in a misleading way and you give appropriate credit to QTex AI. The content of the screenshot should be appropriate (no showing of other users’ data without permission, etc.). If you are an official QTex AI partner or have a media kit from us, follow those branding guidelines. If not, a simple attribution like “Source: QTex AI” on the image or in text is appreciated. And remember, the screenshot itself may contain copyrighted content (the UI elements, etc.), so it should not be used in a manner that suggests endorsement by QTex AI or that confuses people into thinking your publication is official QTex AI documentation.
· Excerpts from Documentation or Website Text: If you need to quote a small portion of QTex AI’s documentation, knowledge base, or other textual content from our site for commentary or integration instructions, you may do so under principles of fair use/fair dealing, so long as the excerpt is limited in scope and necessary for the purpose. For instance, quoting a definition or a short instruction from our API guide in a Stack Overflow answer is likely fine. However, you may not copy large sections of our documentation or publish our user manuals in full without permission. If you’re translating our documentation, or writing a third-party guide that heavily uses our content, reach out to us for permission to ensure you have rights to do so.
· Use of QTex AI’s Name and Logos: “QTex AI”, our logo, and any other product or service names we may adopt are trademarks of QTex AI Inc. You may use the QTex AI name to factually refer to our company or service (for example, “This tool integrates with QTex AI” or “Tutorial for QTex AI”), but you must not use our name or logos in a way that misleads people into thinking your content is officially provided by or affiliated with QTex AI if it is not. You cannot use our logo on your own software or website without prior written permission. If you are a Pro customer and want to indicate you use our service, you can say so in words (e.g., “Powered by QTex AI”) in a manner consistent with any branding guidelines we publish, but don’t combine our logo with yours or use it as a promotion without approval.
· Sharing QTex AI Output & Samples: If you share AI-generated output (that does not include proprietary QTex content) publicly, that’s fine — it’s your content. However, if QTex AI provides sample files, demo projects, or built-in templates as part of the software, those items are QTex AI Content. We typically allow you to use and modify such samples within the context of using the service (for instance, a starter template we provide can be used as a base for your own project), but you shouldn’t redistribute QTex AI-provided templates or code snippets as standalone items outside the platform without permission. They are meant for use with our service.
· Third-Party Content Provided by QTex AI: Sometimes we include third-party libraries, datasets, or assets within our Offerings (with license permissions to do so). Such third-party materials may be subject to their own license terms (which we will document if applicable). You must comply with those third-party license terms in addition to QTex AI’s terms. For example, if an open-source library with an MIT license is included in our product, you can use it as allowed, but that library’s copyright remains with its authors and is not owned by QTex AI. We will make acknowledgments available for any third-party code we use, as required. Conversely, if you incorporate third-party content into your usage of QTex AI (like uploading a model file from elsewhere), you must ensure you have rights to do so and that it doesn’t impose obligations on QTex AI beyond what we’ve agreed to.
Prohibited Uses of QTex AI Content: Unless expressly allowed by this policy or by written permission from us, the following uses of QTex AI Content are not permitted:
· No Rehosting or Cloning: You may not host copies of QTex AI’s software, documentation, or knowledge base on your own servers for others to access (except for transient technical necessities like caching for your personal use). For example, you can’t take our web documentation and put it on your website branded as your own. Nor can you create a competing service by copying our interface or functionality (look and feel can be protected under trade dress/unfair competition laws).
· No Derivative Works: You must not create derivative works of QTex AI’s software or content except as lawfully permitted. Reverse engineering our code or models is prohibited (except as allowed under applicable open-source licenses or mandatory law). You also cannot translate, alter, or build upon our textual or media content for redistribution without permission (aside from content clearly offered under a license that allows it, like if we publish something under Creative Commons – which, unless stated, you should assume we have not).
· No Commercial Exploitation: You cannot sell, license, or commercialize copies of QTex AI Content to others. This includes our software, model outputs that are QTex AI-provided (not your prompts, but e.g. if we gave you a stock dataset), documentation, marketing assets, etc. If you’re in a scenario where you think some QTex AI material would benefit your commercial product or service, talk to us about a partnership or license. Do not just take it.
· No Removal of Notices: Do not remove or obscure any copyright, trademark, or other proprietary notices that appear on QTex AI content. For instance, if an interface screen says “© 2025 QTex AI Inc.” at the bottom, don’t crop that out when using the screenshot in allowed ways. If a QTex AI-provided document has a copyright notice, keep it intact if you share the document within allowed bounds.
3. Reporting Copyright Infringements (DMCA Policy)
While we hope users respect intellectual property, there may be instances where copyrighted material appears on our platform without authorization – for example, a user might upload a file or share content that they do not have rights to, or our AI might inadvertently produce text that matches a copyrighted source too closely. QTex AI complies with the Digital Millennium Copyright Act (DMCA) and similar laws worldwide. We have a process to respond to takedown notices and to address repeat infringers.
DMCA Takedown Requests: If you are a copyright owner (or an agent authorized to act on one’s behalf) and you believe that any content available through QTex AI infringes your copyright, you may submit a written notification to our designated copyright agent. The notice should include:
1. Identification of the copyrighted work you claim is infringed (for example, a specific article, image, or song that you own). If multiple works are infringed, you can provide a representative list.
2. Identification of the material that is claimed to be infringing, with enough detail for us to locate it in the service. This could be a URL to a specific user post or a file name and user account that uploaded it. Please be as precise as possible (simply saying “Your AI platform has my content” is not enough – point us to where the specific content resides).
3. Your contact information – name, mailing address, telephone number, and email address – so we can reach you.
4. A statement that you have a good-faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
5. A statement that the information in your notice is accurate, and under penalty of perjury, that you are the copyright owner or authorized to act on the owner’s behalf.
6. Your physical or electronic signature (typing your full name at the end of the email will suffice as an electronic signature). Our designated copyright agent for notice of claims of copyright infringement can be reached at:
Copyright Agent – QTex AI, Inc.
Address: 10180 W Hickory Ct, Boise, ID 83704, USA
Email: Copyright@QTex.AI
When we receive a valid DMCA notice, we will expeditiously remove or disable access to the allegedly infringing content. We will also notify the user who posted the content (if applicable) that we have taken down the material. Under the DMCA, the user has the right to send us a counter-notification if they believe the takedown was mistaken. Counter-notifications must contain information required by the DMCA (including consent to jurisdiction and a statement under penalty of perjury of the user’s good faith belief that the material was removed due to mistake or misidentification). If we receive a proper counter-notice, we may restore the material unless the original complainant informs us they have filed a court action to restrain the user from infringing (must be filed within 10 business days of our forwarding of the counter-notice).
Please note: This process is for copyright only. False or abusive DMCA notices or counter-notices can have legal consequences. Only send these if you genuinely believe you are in the right. We reserve the right to ignore notices that fail to comply with the above requirements or are clearly fraudulent.
Repeat Infringers: QTex AI will, in appropriate circumstances, disable or terminate the accounts of users who are repeat infringers. If a user repeatedly uploads or posts infringing content after warnings or takedowns, they risk losing access to our Services. We track DMCA notices and strive to identify patterns of abuse. However, we also understand sometimes mistakes happen; we will consider each case carefully. Termination is a last resort but will be enforced to comply with the law and protect rights holders.
4. Use of QTex AI’s Knowledge and Community Content
QTex AI may host forums, Q&A boards, or user galleries where users can share content (like tips, custom prompts, or generated images). Unless explicitly stated otherwise, content shared by users in public areas is not confidential. However, it is still subject to copyright – typically owned by the user who posted it or by whatever source they got it from. You should assume that content posted by others on community forums is for personal use and reference only. Do not scrape or reproduce other users’ posts in bulk. If you want to use a specific user’s contribution (e.g., a helpful code snippet they shared), you might have an implied license to use it for personal purposes (since it was shared publicly for that reason), but you should not compile and publish others’ content as your own.
QTex AI might also publish some articles or answers in the community knowledge base (often marked as official). Those are QTex AI Content and follow the guidelines above – you can refer to them but not republish entirely.
5. Reservation of Rights
All rights not expressly granted in this policy or in our other terms are reserved by QTex AI and its licensors. Nothing in this policy or the Terms of Use constitutes a waiver of QTex AI’s rights under applicable law. We may update or modify this Copyright Policy from time to time. If we do, we will post the revised policy with a new effective date. Material changes will be communicated via our website or by email if appropriate.
By continuing to use QTex AI’s Services, you acknowledge that you will adhere to this policy. Misusing QTex AI’s intellectual property or violating others’ IP rights on our platform can result in suspension or termination of your account and possible legal consequences. We encourage our users to create and share content creatively and responsibly, and to respect the creative works of others.
If you have questions about this policy or need permissions beyond what is granted here (for example, if you want to use QTex AI content in a way not covered above), please contact us at Copyright@QTex.AI with your inquiry. We try to be reasonable and accommodating to legitimate requests while protecting our and others’ rights.
Thank you for helping to maintain a community that values and respects intellectual property.
